By downloading or using the app, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using the app. You may not use our services if you cannot enter into a binding contract with us. By using our services, you acknowledge and accept that you have reviewed our Privacy Policy and, if you do not agree with it, you should not use our services. You’re not allowed to copy, or modify the app, any part of the app, or our trademarks in any way. You’re not allowed to attempt to extract the source code of the app, and you also shouldn't try to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, still belong to Sleepy Rhinos.

 

You represent and warrant that your use of our Services:

• Will be in strict accordance with these Terms;

• Will comply with all applicable laws and regulations (including, without limitation, all applicable laws regarding online conduct and acceptable content, privacy, data protection, the transmission of technical data exported from the United States or the country in which you reside, the use or provision of financial services, notification and consumer protection, unfair competition, and false advertising);

• Will not use the Services for any unlawful purposes, to publish illegal content, or in furtherance of illegal activities;

• Will not infringe or misappropriate the intellectual property rights of any third party;

• Will not overburden Sleepy Rhinos' systems, as determined by us in our sole discretion;

• Will not disclose sensitive personal information of others;

• Will not be used to send spam or bulk unsolicited messages;

• Will not interfere with, disrupt, or attack any service or network; and

• Will not be used to create, distribute, or enable material that is – or that facilitates or operates in conjunction with – malware, spyware, adware, or other malicious programs or code.

 

Sleepy Rhinos is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you’re paying for.

 

The services allow you to access Virtual Items, which may be earned through use of the service or purchased through third party services and are subject to the payment terms and conditions of the relevant platform (e.g., Apple's App Store or Google's Play Store). You agree that Virtual Items are for personal entertainment purposes and may not be refunded or redeemed for any cash value. All purchases of products and services from us, either directly or indirectly, are final and non-refundable, except as required by applicable law.

 

Our services may utilize advertisement and other promotional content from third party platforms and services. These promotions may invite you to participate in offers in return for receiving optional services or Virtual Items. These promotions are subject to their own terms and policies, including privacy policies, and are done entirely at your own risk. We are not responsible for the content of these third-party services and does not imply that we endorse or approve the offer or advertisement. Please reference our Privacy Policy for more information on what information that we collect and how they are used.

 

The Sudoku Travel app stores and processes personal data that you have provided to us, in order to provide our Service. It’s your responsibility to keep your phone and access to the app secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the Sudoku Travel app won’t work properly or at all.

 

You should be aware that there are certain things that Sleepy Rhinos will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi, or provided by your mobile network provider, but Sleepy Rhinos cannot take responsibility for the app not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

 

If you’re using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third party charges. In using the app, you’re accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

 

Along the same lines, Sleepy Rhinos cannot always take responsibility for the way you use the app i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Sleepy Rhinos cannot accept responsibility.

 

With respect to Sleepy Rhinos’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavour to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Sleepy Rhinos accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of the app.

 

At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for both systems (and for any additional systems we decide to extend the availability of the app to) may change, and you’ll need to download the updates if you want to keep using the app. Sleepy Rhinos does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you, We may also wish to stop providing the app, and may terminate use of it at any time without giving notice of termination to you. At our sole discretion, we may suspend, terminate, modify, or prohibit access to accounts on our Services and are under no obligation to compensate you for any losses or results. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

 

Sudoku Travel is only for people 13 years old and over. By using the Service, you affirm that you are over 13.

 

Except for claims for injunctive or equitable relief or claims regarding intellectual property rights (which may be brought in any competent court without the posting of a bond), any dispute arising under the Agreement shall be finally settled in accordance with the Comprehensive Arbitration Rules of the Judicial Arbitration and Mediation Service, Inc. (“JAMS”) by three arbitrators appointed in accordance with such Rules. The arbitration shall take place in San Francisco, California, in the English language and the arbitral decision may be enforced in any court. The prevailing party in any action or proceeding to enforce the Agreement shall be entitled to costs and attorneys’ fees.

 

In no event will Sleepy Rhinos, or its suppliers, partners, or licensors, be liable with respect to any subject matter of the Agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement for substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed $50 or the fees paid by you to Sleepy Rhinos under the Agreement during the twelve (12) month period prior to the cause of action, whichever is greater. Sleepy Rhinos shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent prohibited by applicable law.

 

You agree to indemnify and hold harmless Sleepy Rhinos, its contractors, and its licensors, and their respective directors, officers, employees, and agents from and against any and all losses, liabilities, demands, damages, costs, claims, and expenses, including attorneys’ fees, arising out of or related to your use of our Services, including but not limited to your violation of the Agreement or any agreement with a provider of third-party services used in connection with the Services, Content that you post, and any ecommerce activities conducted through your or another user’s website.

 

Changes to This Terms and Conditions

 

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.
